Preamble
These Terms and Conditions govern the relationship between Séjour Thalasso, hereinafter referred to as “the Platform”, and any person making a booking on sejourthalasso.fr, hereinafter referred to as “the Customer”.
Article 1 – Purpose
These Terms and Conditions define the rights and obligations of the parties in connection with the online sale of services offered by the Platform, namely:
- Thalassotherapy stays and treatments
- Holiday accommodation rentals
- Combined packages (treatments + accommodation)
Article 2 – Role of the Platform
Séjour Thalasso acts as an intermediary connecting:
- Thalassotherapy centers (treatment providers)
- Property owners and concierge services (accommodation providers)
- Customers (travelers)
The Platform is not the direct provider of the booked services. It facilitates the transaction between the parties.
Article 3 – Booking
3.1 Booking process
The Customer selects the desired services and proceeds with online payment. The booking is confirmed upon receipt of payment and validation by the provider.
3.2 Confirmation
A confirmation email is sent to the Customer summarizing the booking details.
Article 4 – Prices and Payment
4.1 Prices
Prices are shown in euros including all taxes. They may vary according to season, availability, and current promotions.
4.2 Payment
Payment is made online by credit card through our secure payment provider Stripe. The full amount is charged at the time of booking unless otherwise stated.
Article 4bis — Payment Conditions for Accommodation Partners
4bis.1 Property Listings
Any accommodation partner (property owner or concierge service) may list a property on the Platform from account creation, regardless of the status of their identity and banking verification process (hereinafter “Phase 2”).
4bis.2 Prerequisite for Payment
The transfer of funds collected by the Platform on behalf of the Partner is conditional upon full completion of Phase 2, which includes in particular:
- Provision of a valid identity document;
- Provision of a property ownership certificate or property tax notice;
- Communication of a valid IBAN;
- Activation of a Stripe Connect account.
Until Phase 2 is completed, funds corresponding to confirmed and paid bookings are held in the Platform’s account pending validation of the Partner’s profile. This holding does not constitute wrongful retention but is a security measure to protect all parties.
4bis.3 Timelines and Escalation Procedure
The Platform implements the following escalation procedure in the event of non-completion of Phase 2 after the first confirmed booking:
- D+7: first reminder email to the Partner;
- D+15: second reminder email and internal alert;
- D+30: urgent follow-up email; the traveller may upon request obtain a full refund;
- D+60: automatic opening of a dispute file; the Platform then has 30 days to reach a decision;
- D+90: in the absence of Phase 2 completion and dispute resolution, the Platform proceeds to a full refund of the traveller, retains its commission as management fees, and suspends the Partner’s account.
4bis.4 Automatic Release
Upon completion of Phase 2, pending funds are automatically transferred within a maximum of 24 hours. The Partner is notified by email.
4bis.5 Acceptance
By listing a property on the Platform, the Partner acknowledges having read these conditions and accepts them unconditionally.
Article 5 – Cancellation and Refund
5.1 Cancellation by Customer
Specific conditions may apply depending on the service providers. They are indicated on the description page of each service. Otherwise :
- More than 30 days before the stay: Full refund minus service fees
- Between 15 and 30 days: 50% refund
- Less than 15 days: No refund
5.2 Cancellation by Provider
In case of cancellation by the provider, the Customer will be fully refunded or offered an equivalent alternative.
Article 6 – Right of Withdrawal
According to French Consumer Code, the right of withdrawal does not apply to accommodation, transport, catering, or leisure services to be provided on a specific date or period.
Article 7 – Customer Obligations
The Customer agrees to:
- Provide accurate information when booking
- Comply with provider rules and conditions
- Arrive at agreed dates and times
- Respect premises and equipment
Article 8 – Liability
The Platform faithfully transmits provider information. It cannot be held responsible for the quality of services, modifications, or damages occurring during the stay.
Article 9 – Insurance
Customers are strongly advised to take out cancellation and travel assistance insurance.
Article 10 – Data Protection
Personal data is processed in accordance with our Privacy Policy and GDPR.
Article 11 – Applicable Law
These Terms and Conditions are governed by French law. Any dispute falls under the jurisdiction of French courts.
